Welcome to TheBludStudio (“TheBludStudio,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of www.thebludstudio.com (the “Website”) and any purchases you make from us, including print‑on‑demand products fulfilled by third‑party partners (e.g., Printful) and any digital downloads we may offer from time to time (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Important: Certain consumer rights are non-waivable in specific jurisdictions (e.g., EU/UK/CA/US state laws). Nothing in these Terms limits rights you may have under mandatory law. Where a provision conflicts with compulsory law, it applies only to the extent permitted.

1) Definitions

  • Customer/You: The individual or entity using the Website or purchasing Products.
  • Products: Physical goods (e.g., printed posters, framed prints) produced on demand; and any Digital Products (e.g., downloadable art files) if offered.
  • Order: A request by you to purchase Products via the Website.
  • Fulfillment Partner: Third parties that manufacture and/or ship Products on our behalf (e.g., Printful).
  • Intellectual Property (IP): All copyrights, trademarks, designs, trade dress, graphics, and associated rights owned or licensed by TheBludStudio.

2) Eligibility & Account

  • You must be 18+ (or the legal age of majority in your jurisdiction) to place orders. If 16–17 in the EU/UK, you must have parental/guardian consent.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • We may suspend or terminate accounts for suspected fraud, abuse, or violation of these Terms.

3) Scope of Services & Changes

  • We may modify, suspend, or discontinue any part of the Services (including products, pricing, features, or content) at any time without liability.
  • Information on the website may occasionally contain typographical errors, inaccuracies, or omissions.
  • We reserve the right to correct them and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit an order), to the extent permitted by law.

4) Product Information & Artwork Variations

  • All artwork/designs are original works owned or properly licensed by TheBludStudio.
  • Colors, textures, and print results can vary due to display settings, substrate, inks, and manufacturing variations. Minor differences are not defects.
  • Sizes are approximate and may vary slightly due to printing/framing tolerances.
  • Mockups are illustrative only; frames, mats, props, and room scenes may not be included unless explicitly stated on the product page.

5) Pricing, Promotions & Errors

  • Prices are listed in the currency shown at checkout and are subject to change without notice.
  • Promotions/discounts are subject to specific terms and may not be combined or applied retroactively.
  • In the event of a pricing or availability error, we may cancel or refuse any Orders placed for Products listed at the incorrect price or availability, even after an Order confirmation, to the extent permitted by law.
  • Any amounts charged will be refunded.

6) Orders, Acceptance & Fraud Screening

  • Submitting an order is an offer to buy; we accept only when we send an order confirmation and/or begin fulfillment.
  • We reserve the right to refuse or cancel orders for any reason, including suspected fraud, IP risk, or policy violations.
  • We may request additional identity, address, or payment verification where risk screening flags an order.
  • Failure to provide the requested information may result in cancellation.

7) Payments & Chargebacks

  • Payments are processed by third‑party gateways (e.g., Stripe, PayPal, Razorpay). We do not store full card details.
  • By placing an Order, you authorize the payment method to be charged for the total amount, including taxes, duties, and shipping (as applicable).
  • Chargebacks/Payment Disputes: You agree to contact support@thebludstudio.com to attempt good‑faith resolution before initiating a chargeback.
  • We contest fraudulent or improper chargebacks and may suspend accounts that abuse chargeback processes.

8) Taxes, Duties & Compliance

  • Taxes: Applicable sales/VAT/GST/HST and similar taxes may be collected at checkout, depending on your location and our obligations. You are responsible for any additional taxes where legally required.
  • Duties/Import Fees: International shipments may incur customs duties, brokerage fees, or import taxes upon delivery; these are your responsibility unless explicitly stated otherwise at checkout.
  • Sanctions/Export Controls: You represent that you are not located in, a resident of, or ordinarily resident in any country or region subject to comprehensive sanctions/embargoes and are not a restricted party under applicable sanctions laws. We may cancel orders to comply with sanctions/export laws.

9) Fulfillment, Shipping & Risk of Loss

  • We use Fulfillment Partners (e.g., Printful) to produce and ship products. Processing (manufacturing) time is typically 2–7 business days, but may vary.
  • Shipping times are estimates and vary by destination, carrier, and season. Delays due to carriers, customs, or events beyond our control do not constitute breach.
  • Risk of Loss/Title: Except where prohibited by law, title and risk of loss pass to you upon delivery to the carrier at the Fulfillment Partner’s facility. Where consumer law requires, risk passes on delivery to you.
  • Address Issues: You are responsible for providing a complete and accurate shipping address. Undeliverable/returned packages due to address errors may be reshipped at your cost.
  • Damage in Transit: Inspect packages upon receipt. Report visible damage to the carrier upon delivery, where possible, and notify us within 7 days with photos of the product and packaging.

10) Returns, Refunds & Replacements (Print‑on‑Demand)

  • Because Products are made to order, we generally do not accept returns or exchanges for buyer’s remorse (wrong size, color preference, etc.).
  • We replace or refund only for defective, misprinted, or damaged items. Claims must be submitted within 7 days of delivery with photo evidence and the order number.
  • If a replacement is approved but the item is out of stock, we may issue a refund.
  • Where required by mandatory consumer law (e.g., EU/UK), your statutory rights remain unaffected.

11) EU/UK Right of Withdrawal (Custom‑Made Exception)

Consumers in the EU/UK typically have a 14‑day right of withdrawal for distance purchases. However, under Directive 2011/83/EU (and local UK/EU implementations), custom‑made or on‑demand products are exempt once production has started. Our print‑on‑demand items fall under this exemption. This does not affect remedies for defective goods under statutory law.

12) Intellectual Property & License Restrictions

  • All IP in the products, website content, and branding is owned by or licensed to TheBludStudio and protected by global IP laws.
  • You may not copy, modify, reverse engineer, distribute, publicly display, or create derivative works from our content or products, except as expressly permitted in these terms.
  • Any rights not expressly granted are reserved.

13) User‑Generated Content (UGC), Reviews & Permissions

  • If you submit reviews, photos, or other content (“UGC”), you grant TheBludStudio a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from that UGC in any media for marketing, promotion, and operation of the Services.
  • You represent that you own/control rights in your UGC and that it does not infringe the rights of others or contain unlawful content.
  • We may remove or refuse any UGC at our discretion.

14) Prohibited Uses

You agree not to:

  • Use the Services for unlawful purposes or to infringe IP rights.
  • Upload malicious code, attempt to gain unauthorized access, or disrupt the website.
  • Use automated scraping, crawling, or data extraction without our prior written consent.
  • Circumvent technical measures (e.g., watermarks, DRM) protecting our content.

15) Third‑Party Services & Links

  • We use third parties for payment processing, manufacturing, analytics, and shipping. Their services are governed by their own terms and privacy policies.
  • We are not responsible for third‑party websites or services linked from the Website.

16) DMCA/EU Notice & Takedown

  • If you believe content on the Website infringes your copyright, please email support@thebludstudio.com with (a) your contact details, (b) identification of the copyrighted work and the allegedly infringing material (URL included), (c) a statement of good‑faith belief that use is not authorized, and (d) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act.
  • We will review and respond pursuant to applicable laws (e.g., DMCA in the US, EU/UK equivalents).

17) Disclaimer of Warranties

  • AS‑IS/AS‑AVAILABLE: To the maximum extent permitted by law, the Services and Products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non‑infringement.
  • We do not warrant uninterrupted or error‑free operation, accuracy of product descriptions, or that defects will be corrected.

18) Limitation of Liability

  • To the fullest extent permitted by law, TheBludStudio and its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including lost profits, loss of data, business interruption) arising from or related to the Services or Products, even if advised of the possibility of such damages.
  • Where liability cannot be excluded, our aggregate liability for all claims relating to the Services or Products shall not exceed the total amount paid by you for the specific Order giving rise to the claim.

19) Indemnification

You agree to indemnify, defend, and hold harmless TheBludStudio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use or misuse of the Services or Products, (b) your breach of these Terms, or (c) your violation of any law or the rights of a third party.

20) Force majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, epidemics, wars, sanctions, labor disputes, supply chain interruptions, carrier delays, or governmental actions.

21) Dispute Resolution; Governing Law; Venue; Class Waiver

  • Informal Resolution: Before filing a claim, you agree to email support@thebludstudio.com for a good‑faith resolution attempt.
  • Governing Law & Venue: These Terms are governed by the laws of [Insert Governing Law & Country/State], without regard to conflict of law rules. The exclusive venue for disputes is [Insert Courts/City], except where consumer law grants you a right to bring actions in your local courts.
  • Arbitration (Optional for US Customers): If you reside in the United States, any dispute may, at our election, be resolved by binding arbitration on an individual basis under the rules of the AAA. Class actions and class arbitrations are waived. You may opt out of arbitration within 30 days of first use by emailing us.
  • Nothing herein prevents you from bringing an individual action in small‑claims court where jurisdictional limits permit.

23) Assignment

  • Our failure to enforce any provision is not a waiver of our rights.
  • If any provision is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions remain in full force and effect.
  • These Terms, together with our Privacy Policy, Refund/Return Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Services.

25) Region‑Specific Terms

  • EU/UK: Consumers retain mandatory rights regarding conformity of goods and remedies for defective products.
  • California (USA): Where applicable, you acknowledge receipt of any legally required notices under California law. We do not sell personal information as defined by the CCPA/CPRA—see our Privacy Policy.
  • Canada: Purchases are subject to applicable GST/HST/QST/PST. Consumer protection rights under provincial/territorial law remain unaffected.
  • India: Indian consumers’ rights under the Consumer Protection Act, 2019, remain unaffected.

26) Category‑Specific Disclaimers

  • Quotes/Classic Works: Where artwork incorporates quotes or styles inspired by older works, we use material believed to be in the public domain or used under license. We make no claim of affiliation/endorsement by historical figures or estates unless expressly stated.
  • Cultural/Religious Themes: Artistic works referencing cultural or religious motifs are creative expressions and are not endorsements or authoritative representations. No offense is intended.

27) Security, Scraping & Rate Limits

  • You must not attempt to probe, scan, or test the vulnerability of the website or circumvent security measures.
  • Automated scraping, data mining, or the use of bots is prohibited without prior written permission. We may employ technical measures (including IP blocking and rate limiting) to protect the Services.

28) Accessibility & Language

  • We aim to make the website reasonably accessible. If you encounter accessibility issues, contact support@thebludstudio.com.
  • These Terms are provided in English. Translations (if any) are for convenience; in the event of a conflict, the English version controls.
